In recent days, hacker Nham Hoang Khang has become a name mentioned a lot on MXH. With the nickname “You IT”, Khang is the one who published the conversation related to the noisy case of artist Hoai Linh, People’s Artist Hong Van, Dam Vinh Hung, artists Duc Hai, Phi Nhung, Ho Van Cuong… public opinion was agitated.
It was the “IT guy” who also revealed the fact that comedian Hoai Linh had not given 14 billion VND to charity to help the Central region, causing the male artist’s career to suffer.
Accordingly, Nham Hoang Khang actively infiltrated the comedian’s personal account information. Thereby, Nham Hoang Khang discovered the incident related to 14 billion dong of charity money and important conversations between some artists in Vietnamese showbiz.
Also according to Nham Hoang Khang’s share, he said that this was the first time he arbitrarily infiltrated the accounts of Hoai Linh and some other artists just because he hated deception.
The male IT himself also said that he is aware of his behavior and is ready to be punished at any time without anyone standing up for him.
In addition to artist Hoai Linh, Nham Hoang Khang also revealed that he had found the person who texted and blackmailed artist Duc Hai. Specifically, this person hired a spam message service from Khang’s juniors.
Accordingly, Khang said that a junior named H. revealed that a customer named Hoa H. had hired a spam service to blackmail artist Duc Hai and the extortion content would be “blamed” by male IT.
After that, male hacker Nham Hoang Khang once again caused a stir in public opinion when he published an article revealing the real person of Phi Nhung and stood up to call for help to find justice for Ho Van Cuong.
Although the public agrees to expose deception in showbiz, many people believe that this is the act of using tricks to access other people’s personal page accounts and spread information, infringing privacy rights of others.
Looking at the case from a legal perspective, lawyer Dang Van Cuong – Hanoi Bar Association said that the right to privacy, protection of privacy rights, correspondence, phone calls, telegrams, etc. is one of the basic human rights stipulated in the Constitution, the Civil Code and other relevant documents in Article 21 of the 2013 Constitution.
Regardless of the purpose and motive, intentionally illegally infiltrating other people’s personal accounts in cyberspace is a violation of the law and is strictly prohibited. Therefore, the hacker’s behavior violates Article 8, the 2018 Cybersecurity Law.
The regulation clearly states that unauthorized access to Facebook of others is a violation of the law. Depending on the nature and severity of the act, depending on the consequences, the violator may be administratively fined or examined for penal liability. If causing damage, he/she must pay compensation according to the provisions of law. law.
Lawyer Cuong said that Nham Hoang Khang may have to receive a fine for the crime of Infringing on the confidentiality or security of correspondence, telephone, telegraph or other forms of exchanging private information of others according to Article 159 of the Ministry of Finance. Criminal Law 2015 amended and supplemented in 2017.
If found guilty, male IT can be fined from 20-50 million dong or non-custodial reform for up to 3 years. In addition, if the crime is organized; disclosing appropriated information, affecting the honor, reputation and dignity of others, or causing injury to the victim, shall be sentenced to between 1-3 years of imprisonment.
